    AI Art is not allowed in any form to be sold at Frederick events.

    Applications review will start in March. 

    Market vendors have the opportunity to join our signature events. To participate as a market vendor, your business must fit into one of these three categories:

    • Grower/Producer/Food – Includes growers and producers selling fresh produce, garden plants, potted herbs, cut flowers, seeds, honey, roasted chilies, frozen meats, breads, and ‘homemade’ foods. This category excludes food trucks and vendors who prepare food onsite at the event. Food trucks must complete the food vendor application to participate in Frederick events. ‘Homemade’ food items must be prepared in a commercially licensed kitchen per state and county health regulations unless you’re selling under the Cottage Food Act. A copy of the license must be posted at the booth or available upon request. The State Health Department has regulations for ‘prepared food’, which includes roasted chilies. Perishables must be held at certain required temperatures with refrigeration or heat. Samples of fresh produce or other food items must follow food safety guidelines to protect customers as well as yourselves. If you have questions about those regulations, contact the Weld County Health Department at 970-304-6420. Vendors must follow Department of Agriculture guidelines for method of sale related to weights and measures. State or federal regulations require processed foods including jams, pickles, canned beans or other vegetables to comply with FDA labeling regulations. Eggs may be sold if the vendor has a licensed facility. There may be exceptions, so contact the Weld County Health Department or the CO Department of Agriculture for more information. If you wish to serve ready to eat, non-factory packaged food at Frederick events you must have a permit from the Weld County Health Dept. The permit must be displayed at your booth. To be classified as a grower/producer at least 75% of the products available at your booth must be grown/produced by you.  
    • Artisans/Crafters– Includes original handcrafted items personally created by you, the vendor, including designs you incorporate into your products. This means that pop culture characters and references, as well as any other copyrighted or trademarked content, are not permitted. Crafts need to be preapproved. Acceptable crafts include fresh/dried flower arrangements, woodworking, garden sculptures, quilts, clothing, crochet/knitting, soaps, etc. Vendors using raw materials they produce (i.e. wool from your own animals) may qualify to sell as a grower/producer. Items not allowed include artificial flower arrangements, paint-by-number, etc. Resale and secondhand items are not allowed. AI art products are not allowed.
      • If we suspect that your artwork is not original, we will ask for the working file of your artwork.
    • Non-Profit Groups – Non-profits must abide by all event rules and regulations and may not sell any items that do not fit within the two categories listed above.

    Complete this application to be considered for participation as a market vendor. Please do not send payment until you have been contact with confirmation of acceptance.

      • Stickers produced by a third-party printer
      • Tote bags or hats made by a manufacturer
    • Resale or commercially manufactured goods
      • Mass-produced decor or accessories
      • Items bought online and resold
    • Ai-generated artwork
    • Copyrighted or trademarked content not created by the vendor
      • Pop culture characters
      • Move, TV, video game, or sports team logos
    • Secondhand or vintage items

    Items must be designed and physically created by the vendor. Vendors may be asked to provide examples of their process or working files to verify original work.

    The Town reserves the right to accept or reject applicants and to make the final determination as to classification. Your organization must fit into at least one of the following categories.
  8. Colorado Department of Revenue Tax License Information

    All sellers participating in the event must collect the applicable state and state-administered local sales taxes due and remit the sales tax collected to the Department of Revenue.

    Vendors using these will be located to reduce impacts to customers and other vendors from noise/fumes/safety hazards. Please note, there is no guarantee that you can bring these items to the event and you may be asked to refrain from bringing these items.

  17. Booth Reservations

    Booths will be 12x12 feet and flagged on the grass. Vendor maps, unloading instructions and any other details will be emailed the week of the event. 

  18. Sales Reports

    All vendors are required to report and remit applicable sales taxes to the State of Colorado. Produce and food items are exempt from Frederick municipal sales tax. Ready-to-eat foods (breakfast burritos, hot coffee, etc.) and non-food goods are subject to municipal and State sales tax (6.4% total). We will also ask you to report your end of day sales to the Event Manager for research purposes.

  19. Power Access

    Power is not available to market vendors. 

  20. Vendor Payment Information

    Participation Fee and Application

    • All vendors will be charged a $25 participation fee per event, pending approval by the event manager.
    • Full payment and a completed application must be submitted at least three weeks prior to your first market date.

    Refunds

    • The Town will not issue refunds for booth reservations under any circumstances.

    No-Show Policy 

    • Vendors who fail to provide notice of non-attendance at least 1-week prior to an event will incur a $50 no-show fee. This fee must be paid before the vendor is allowed to participate in future markets and events.

  22. Vendor Rules & Regulations

    Town of Frederick events are designed to create a family-friendly atmosphere and to bring the community together. As a vendor or exhibitor, Town of Frederick asks that you follow the rules and regulations outlined here. 

    1. Vendor booths will operate during the entire advertised time frame set by the Communications & Engagement department. No vendors will be allowed to arrive late, or leave early.
    2. Vendors must give Town of Frederick at least 1 week-notice if you will not be in attendance of the event. Approved vendors dropping out of the event prior will forfeit their vendor fee. If a vendor misses two events without letting the Town Staff know, they will no longer be allowed to sell at Frederick events and will forfeit all vendor fees and/or rebates.
    3. Canopies are required. They must be clean and in good repair. They must be secured with at least 40 pounds of weight per corner to prevent damage or injury. Plastic 5-gallon buckets filled with water, gym weights and sand bags are a few examples for tent weights. The Communications & Engagement Specialist and/or other officials may order the immediate removal of canopies that are unsecured or in poor condition.
    4. Vendors must provide their own tables and equipment for display of merchandise. Tables, equipment and/or displays that are in poor repair or that pose a potential hazard will not be allowed. Please ensure your display is in good taste and is inviting for patrons.
    5. Vendors offering food samples will comply with food sampling guidelines and have required hand-washing stations. If you are unsure about the food sampling guidelines, please contact the Weld County Health Department at (970) 304-6415 or email HE-tempevents@weldgov.com.
    6. Vendors will behave in a professional and courteous manner. Hawking or yelling to attract attention is not allowed. Treat town staff, volunteers and other vendors with respect.
    7. Vendors shall accurately report total sales to Communications & Engagement Specialist at the end of each event day. The Town of Frederick will not be collecting sales tax. The total sales you report are for market research only, as it is the vendor’s responsibility to remit all applicable state and local tax to the State.
    8. Booths must be removed no later than one hour after the close of the scheduled time frame. Vendors may not leave the event before the official end of the scheduled time frame. Leaving the event early will result in the vendor forfeiting opportunities for future events. Express consent to leave prior to event end time will be granted by the Communications & Engagement Specialist for emergencies only. If a vendor sells out before the close of event, they should display a “SOLD OUT” sign at their booth. Their tent, tables and sign must stay up the entire duration of event.
    9. No smoking is allowed at the event site.
    10. All organizations that require a food license must be able to provide documentation of that license during any event. If you are unsure whether or not you require a food license for what you will be selling, contact the Weld County Health Department at (970) 304-6415 or email HE-tempevents@weldgov.com. If you are found to be operating without a license or outside the limitations of your current license you will be asked to leave the event.
    11. Your vendor space will likely change throughout the season as we make adjustments for changes in each event. We will do our best to accommodate your requests, but cannot guarantee that we will be able to fulfill it. We appreciate your understanding as we work to make every vendor successful! You will receive a map with event details prior to the event.
    12. Some products are not allowed at Frederick events. The Town of Frederick reserves the right to make the final determination of products that will be allowed for sale. If any items are determined to be unacceptable for sale at the event, staff will ask the vendor to remove them immediately. Failure to do so will result in the vendor being ordered to leave the premises.
    13. Vendors will not be allowed to set up and sell at Town events without a signed application on file at Town Hall. Applications and payments must be turned in at least two weeks before your first event date. 
    14. Vendors are responsible for leaving their assigned area clean. All debris must be removed from the premises. Excessive refuse or other conditions requiring cleaning by event staff may result in a cleaning fee. Please do everything you can to minimize the impact on the grass.
    15. Bringing your pet is discouraged. If you do decide to bring your pet to the event, please be sure they stay within your booth space, are well behaved, and do not come in contact with any food products being sold. Any pets that are causing disruption at the event will be asked to not return.
    16. No playing of electronic music or sound recordings at vendor stands is allowed during event hours.
    17. The Town of Frederick will designate load-in and load-out locations specific to each event. For safety reasons, vendors are required to stay within the designated areas and are not permitted to deviate without express consent from the Communications & Engagement Specialist. This may include open areas such as parks and grass.
    18. The Town of Frederick is required to remit a complete list of vendors to the State of Colorado Department of Revenue following each event (INFO HERE). Please be aware your contact information will be share in this capacity should you be approved and participate in the event.
    19. Proof of Insurance - Vendor shall provide a Certificate of Insurance evidencing the below coverage naming the Town of Frederick as Additional Insureds prior to full approval, participation, or commencement of services. Failure to provide acceptable proof of insurance may result in denial of participation or termination of the agreement.


      Vendors that cannot provide the Town with proof of insurance with the Town of Frederick listed additionally insured will be included in special event insurance coverage through the Town’s insurance provider and charged accordingly. 

      Insurance Requirements - Vendor shall, at its own expense, procure and maintain insurance coverage with companies authorized to do business in the State and acceptable to the Town as follows:

      - Commercial General Liability - Commercial General Liability insurance with limits of not less than $1,000,000 per occurrence and $2,000,000 general aggregate, covering bodily injury, property damage, products/completed operations, and contractual liability.

      - Automobile Liability (if applicable) - Automobile Liability insurance covering all owned, non-owned, and hired vehicles used in connection with vendor operations, with a combined single limit of not less than $1,000,000 per accident for bodily injury and property damage.

      - Workers’ Compensation / Employer’s Liability - Workers’ Compensation insurance as required by State law and Employer’s Liability insurance with limits of not less than $1,000,000 each accident, $1,000,000 disease – policy limit, and $1,000,000 disease – each employee, if the Vendor has employees.

      Independent Contractors / Sole Proprietors - Vendors who do not have employees and are exempt from Workers’ Compensation requirements must provide a signed Independent Contractor Agreement or Workers’ Compensation Exemption, as permitted by State law.



  23. I have read the Vendor Application and am aware of the responsibilities and liabilities I assume under the 2026 Vendor/Exhibitor Rules and Regulations, and agree to abide by all Market Rules as well as all applicable local, state and federal regulations. I will comply with directions issued by the Market Manager and other Town officials. I understand that failure to do so will be immediate grounds for temporary or permanent expulsion from the Market and forfeiture of any amounts paid to use or reserve a booth or other space at the Market.
